What Does “No Fee Until You Win” Mean?

No fee until (or unless) you win means you don’t have to pay us unless you settle or win your personal injury case. It’s also known as a contingency fee agreement. Instead of asking you for upfront costs, we reimburse ourselves for the legal fees and other related expenses for your case out of your final settlement. This fee structure allows you to hire us — or almost any personal injury attorney — without scraping together upfront legal fees that you may not be able to afford right now, allowing you to take advantage of our legal services with very little financial risk to you.

What Happens If I Don’t Win My Case?

In rare circumstances, you may not be able to settle your personal injury claim. If that happens, you won’t owe your personal injury law firm anything. That’s how a contingency fee works. You’re not charged a single penny for your lawyer’s services.

However, some personal injury lawyers will charge you for certain court fees or other expenses related to your case. It’s critical to ask your attorney for and get a written record of which fees you are expected to pay, no matter the outcome of your case.

What Happens With the Contingency Fee If I Change Lawyers During My Case?

You have the right to change legal representation during your personal injury claim. If that happens, you’ll still pay one contingency fee, which may be split between your former personal injury attorney and the new one, depending on how much work each lawyer does for the case. And you still shouldn’t have to pay any attorney fees before settling your case.

In some cases, your former attorney may file an attorney’s lien, which places a “hold” on your settlement to ensure they’re paid for the work they’ve already done on your case. The lien is generally negotiated between the old and new law firm and not something you would typically negotiate.
