Personal Injury Settlements in Washington State: How You Get Paid

It’s a common assumption that once a personal injury settlement is agreed upon, a check is on its way. In reality, the agreement is just the beginning of the payout process. Whatever the circumstance, there are several steps between a signed agreement and money in hand. 

How the Payout Process Works

Whether it was a car accident, a motorcycle accident, or a slip and fall, the steps from signing your settlement agreement to getting paid are largely the same. Here’s what you can expect, step by step, from your signature to the final payout.

Step One: Signing the Release

Before any payment is issued, the injured party is typically required to sign a document called a release of claims. It releases the insurance company and any third parties, such as doctors or medical facilities, involved in the lawsuit from any further responsibility. In essence, this means they are free from any future claims, demands, or rights arising from the incident.

Once the release is signed and a settlement is accepted, the case is over and cannot be reopened. That means you cannot collect additional compensation if you have additional medical expenses, lost earnings, or discover new injuries related to the same claim. 

Step Two: The Check Enters Your Attorney’s Trust Account

The insurance company will issue your settlement check to both you and your attorney’s firm, and the check must be deposited into the firm’s trust account before you receive any of the payout.

Washington state law requires attorneys to keep settlement funds in a separate trust account to prevent your money from being used for the firm’s daily operations or any other expenses unrelated to your settlement. It gives your attorney a secure place to hold the full payout while they determine how much will go toward medical liens, attorney fees, and other case costs, so you don’t have to worry about handling all those payments once the money comes in.

Once the check is sent, you can expect to receive your settlement check within two to six weeks. Several variables can impact the exact timeline; however, insurance companies must issue your payment within a 15-business-day deadline once the release is signed, as mandated by Washington state law.

Step Three: Liens Are Resolved

The main variable that can impact how quickly you receive the settlement is medical liens. A lien gives a third party, like your doctor or the hospital, a legal right to a portion of the settlement proceeds, and any outstanding liens must be addressed before you receive your portion of the personal injury settlement.

Liens usually exist because someone else covered your medical bills while your case was pending. A hospital, health insurer, or government agency may have paid for your treatment upfront with the understanding that they’d be reimbursed once you settled. That’s the purpose of a lien: you get the medical care you need, and the medical provider gets their payment right away, without waiting for the case to resolve. 

Washington personal injury settlements allow for several types of liens, including:

  • Medical provider liens: Outstanding balances owed to hospitals, clinics, physical therapists, or other healthcare providers who treated your injury.
  • Health insurer subrogation: If a private health insurer paid for injury-related treatment, it may have a contractual obligation to recover those costs from the settlement. This process is called subrogation, and it means that your insurer steps in to collect what has already been paid out.

An attorney can negotiate a lien to reduce the amount owed, which may increase the amount that you will ultimately receive. 

Step Four: Attorney Fees and Case Costs Are Deducted 

Attorney fees and case-related costs are deducted from the settlement amount before you receive the remaining settlement funds. Personal injury attorneys in Washington typically work on a contingency fee basis, meaning they receive a percentage of the settlement as opposed to an hourly rate. Case-related costs cover court filing fees, expert witness fees, and other litigation-related expenses. 

The attorney will prepare a settlement statement detailing how the proceeds will be distributed. This statement will show the gross settlement amount, all expenses, and the final net amount payable to you. Once the release is signed and the settlement amount is agreed upon, you have two primary options for how the personal injury settlement is paid out.
